Commissioner Redmond next began a presentation and discussion of a report by the BARNABY STREET TREE TASK FORCE, which included information provided by Mr. Dean Gardis concerning the status of the trees on Barnaby Street and by Mr. John Mueller regarding the clear need for certain amendments to the governing laws and regulations regarding tree topping and tree removal.
The final report of the Task Force was presented to the Commission, including recommendations for specific changes to the laws and regulations (much of this information had been provided in testimony to the DC Committee on Public Works and Environment at a meeting held on December 9, 2004).

Commissioner Redmond introduced three letters for review and approval of the Commission, as follows:


  • (i) to Ms. Ainsley Caldwell, Urban Forestry Administration, endorsing the findings of the Task Force regarding procedures for the pruning and removal of ten trees on Barnaby, Utah, and Tennyson Streets;

  • (ii) to Council Member Adrian Fenty requesting that he offer amendments to the governing laws regarding the exemption granted to PEPCO from the Urban Forestry Act and from the usual required notification process; and

  • (iii) to Mr. Dan Tangherlini, Director of DDOT, asking him to promulgate emergency rules to ensure that PEPCO and other utilities acquire all necessary permits before proceeding to remove any trees from public space.

After discussion, the sending of all three letters by the Commission was approved by a vote of 7-0 each.
